.239 Administrative Conference Request
Generate a letter requesting an expedited .239 administrative conference at the Court of Administrative Hearings (CAH) in response to a Notice of Intention to Discontinue (NOID).
What is a NOID?
A Notice of Intention to Discontinue (NOID) is a formal notice from the insurance company that they intend to stop paying your workers' comp benefits. The NOID process is governed by Minn. Stat. § 176.238 (notice and discontinuance procedure) and Minn. Stat. § 176.239 (expedited administrative conference and interim decision).
If you disagree with the NOID, you can request a .239 administrative conference(an expedited interim decision). Do not ignore a NOID — the time windows to request a .239 conference can be very short.
Time-sensitive (Minn. Stat. § 176.239, subd. 2)
- Not return-to-work: request must be received by CAH within 12 calendar days after the NOID is received by the commissioner.
- Return-to-work: if you believe benefits should be reinstated due to an occurrence during the first 14 days after returning to work, the request must be received within 30 calendar days after return to work.
- If the NOID was not properly served/filed, the time to request a .239 conference can be extended up to and including the 40th calendar day (see the statute text).
These triggers can be hard to match to the date you personally received the NOID. If you're unsure, act immediately and consider using CAH eFiling or calling CAH to request a .239 conference.

A .239 administrative conference request is often due in 12 or 30 days (with certain 40-day extensions) depending on the type of NOID. If you miss the .239 window, you may still be able to file an objection to discontinuance under Minn. Stat. § 176.238 (a separate path).
